If your child was hurt in an accident, the law protects your childs rights. In New York, children can sue for 3 years after they turn 18. Another way of thinking about it is they have to sue before they turn 21.
But, a parent certainly doesn't have to wait that long and can commence legal proceeding much sooner, even soon after the accident.
The first thing to do after a child, or anyone really, is involved in an accident is call 911 and report the accident, the location etc. If an ambulance is called, the injured person should be brought to a hospital for initial evaluation. Whatever occurs in the hospital, its important to follow up with your pediatrician who can further assess the injury and refer you to the appropriate specialist if need be.
