Earlier in my career, I was in a building meeting a client when another person approached me. He asked if I was the building's lawyer. I said no, I handle accident cases. He said we had an accident and invited me upstairs to his apartment where he introduced me to his now 14 year old son and explained that the son had fallen out of a window in his room and landed in the parking lot, having fallen 6 flights. The son survived but was seriously injured. The family had no idea they could sue anyone as they thought it was the son's fault. After researching the issue and examining the accident site, I determined that a lawsuit would be appropriate against the landlord for failing to have effective window guards in the building. There was a window guard in the window the child fell from, but the window guard failed to stop the child from falling. After a few years, we were about to try the case when the insurance company offered three quarters of a million dollars to the injured boys parents for the benefit of the boy. The family accepted and the matter was settled. But this story shows how kids get seriously injured and people have no idea they can sue for the injuries. I have handled too many car accidents involving children where children are crossing the street and hit by a car. Or children may also be a passenger in a car and get hurt in an accident. Recently, I represented the parent of a three year old boy who had a fractured jaw in a car accident. We sued the driver of the car the boy was in (his father) and a police car. The father's insurance agreed to pay their entire insurance policy to all the people involved in the accident. The police refused to pay anything to the boy claiming the accident was not the police officer's fault. I disagreed and am now waiting for the Court to endorse my argument that the police are also responsible for the accident as the police car was driving too fast and with defective brakes. I am hopeful this boy will recover well for his injury.
